he has an active arrest warrent why isn't he being arrested the second he stepped foot on soil?

This is in New York. The US has never been part of the Rome Statute, which is the treaty that established the International Criminal Court.

Every American leader since Clinton has been too cowardly to commit to prosecuting war criminals. Maybe not too surprising since there's a strong argument to be made that they have all been war criminals themselves.

What's new with Trump is that he's actively attacking the ICC, but America has always been a safe haven for war criminals. "Nazi, Schmazi!" says Wernher von Braun.

That said, hasn't Mamdani promised to arrest Netanjahu if he wins the Mayoral race?

[-] RaoulDuke@piefed.blahaj.zone 6 points 2 weeks ago

Does he really have that power?

[-] SpaceNoodle@lemmy.world 13 points 2 weeks ago

Might as well find out

No, bibi is rich and

okay

which means he will never get in any real trouble in the US

The rich will sooner personally shoot Mamdani on 5th avenue than allow this to happen

From a legal standpoint, the Rome statute only grants ICC jurisdiction in places that signed the statute, which New York does not have the power to do. The US constitution grants the president (with consent of senate) exclusive authority to enter into treaties.

If he's within physical jurisdiction and Mamdani directs the NYPD to honor the ICC arrest warrant... I don't have the legal credentials to say whether or not that would fly

Interesting how that's where the UN is.

The institutions are scatterd around the world, but the general assembly is in the headquarters in NYC. I guess the idea was that it's the capital of the world or something.

[-] lime@feddit.nu 4 points 2 weeks ago

isn't the un building "international soil" or something?

[-] Tenderizer78@lemmy.ml 1 points 2 weeks ago

It would require a constitutional amendment apparently, and that's not happening.

[-] TachyonTele@piefed.social 9 points 2 weeks ago

Because that stuff doesn't matter to someone at his level.

[-] Egonallanon@feddit.uk 7 points 2 weeks ago

The US is not a signatory to the rome statute and does not participate in the ICC so the warrant means nothing.
