If your friend wouldn't let you copy his DVDs to help artists defend themselves from being outright replaced by a soulless bot with no creativity of its own, they aren't your friend.
Noone is being prohibited from using the code, the code can be used if they comply with the license, which they didn’t.
Do they make money off the snakeoil from artists? No. But they still make money off the snakeoil, they made quite a bit of it with glaze in the form of research grants etc, likely the same with nightshade. And in the end they just peddle false hope.
