If by "in bad faith," you mean, "with mostly benevolent intent but sadly in contradiction to the impotent dictates of the bad-faith-est of bad-faith actors in the music creation community for the last fifty years," then, accurate.
So because the average person is aware that it's difficult to download off YouTube, that means any attempt to make it easier is "acting in bad faith"?
Is it "bad faith" to replace your phone's battery because it requires some specialized tools? Is it "bad faith" to change the oil in your car instead of bringing it to a service center?
"Good faith" = corporations screwing you
"Bad faith" = you screwing corporations
There, I've simplified it.
To give some additional context: The Hamburg court is easily one of the worst institutions in all of Germany. They are infamous for ruling in favor of large corporations and against "the little guy". One of their judges even had the nickname "Judge Merciless". They don't care about the facts, they are just looking for a way to please the corporation without it being too obvoius.
Wait, is he the reason we call corporate apologists "schills"?
Wouldn't this same logic require vlc media player of all things also be taken down, as it is possible to use it to download YouTube videos?
Aah, Hamburg. I'm not sure if the content industry bribed/threatened all judges there or if they are truly such a collection of idiots. These guys are almost a joke in Germany already and have been for years. There's a reason why almost all major copyright cases are held there.
