Most likely a designer built these forms intentionally from requirements that tell him what elements need to be on each screen. It would be very simple to add an extra 'opt out' next to the opt in. The reasons the opt out option isn't there are numerous. Most are not intentionally deceptive but some are. I've found that a legal requirement for something to be in place is a strong incentive for business to make it happen.
