I feel like you'd lose the case, be countersued and owe millions before he ever even found out about it.
Probably not, but he would drag it through court for as long as possible until you can't afford to continue, and he probably would countersue and do the same. You'll have to settle before he does even if the case is obvious. The system is broken.
