Everybody identifiable in that image honestly should sue Elon Musk for defamation. It's likely an open-and-shut case. He should feel some pain every time he makes these accusations.

Probably not, but he would drag it through court for as long as possible until you can't afford to continue, and he probably would countersue and do the same. You'll have to settle before he does even if the case is obvious. The system is broken.
