I'd like some musician's take on this. It sounds different enough to me. It has the first 3 rising notes, but after that goes different. But I am far from musically inclined.

The Wikipedia article only says that an undisclosed sum was paid for the use of the Lazy Jones sample.

Lazy Jones and KernKraft 400 sound similar. Those compared to Electronic Ensemble sound different enough.

Yes, exactly. I suppose the Electronic Ensemble would have been compensated as well if there were more similarities. Still, the song may have been an inspiration. Just like the song Taurus by the band Spirit is in parts kind of reminiscent of Led Zeppelin's Stairway to heaven (Spirit could not claim intellectual property rights in court).
