We had a real, similar case like this not too long ago in Finland (extensive article from Finnish national broadcasting company, NSFL text).

Court concluded that no one can give consent to be tortured/maimed/etc.

There is quite a large difference between bdsm and torture pratice. Nobody enjoys being waterboarded in Prime energy drink

I think we can at least say that if they ended up in front of a judge about it, the receiver might not have enjoyed it quite as much as the 60 page legal contract suggested.
