The President deploying Marines inside the U.S. without invoking the Insurrection Act, declaring an emergency, or getting local/state approval โ€” especially just to respond to peaceful protests โ€” is unlawful on multiple levels:

  • ๐Ÿ”น Violates DoD Directive 3025.18 โ€“ Active-duty military (including Marines) canโ€™t engage in domestic law enforcement unless explicitly authorized.
  • ๐Ÿ”น Violates the First Amendment โ€“ Peaceful protest is protected. Military suppression = unconstitutional. (NAACP v. Claiborne Hardware Co., 458 U.S. 886).
  • ๐Ÿ”น Violates the Fourth Amendment โ€“ Military detentions/searches are illegal without cause. (Indianapolis v. Edmond, 531 U.S. 32).
  • ๐Ÿ”น Ignores Posse Comitatus limits โ€“ PCA (18 U.S.C. ยงโ€ฏ1385) applies to Army/Air Force, but DoD extends it to all branches.
  • ๐Ÿ”น Unlawful military orders โ€“ Troops must disobey unconstitutional orders (UCMJ Art. 92; U.S. v. Calley, 48 C.M.R. 19).
  • ๐Ÿ”น Impeachable abuse of power โ€“ Violates Article II, Section 4 of the Constitution.

This isnโ€™t just controversial โ€” itโ€™s flat-out illegal.

Legal or not, the Capitalist state is flexible and do what it wants and what it needs. It isn't bound by the laws it sets for itself, it can always ignore them if it wants to.

The administration is citing the oft-ignored statute of: "The President can do whatever he wants, lol, lmao even."

There's this clause about the Senate Pastafarian saying the President doing things is uncouth, but I think that only applies to liberals.

This is a clear violation of posse constitution, yes? Not that I expect that to stop them, they've been ignoring courts left and right, dunno why the constitution would be any different.
