Federal immigration officers are asserting sweeping power to forcibly enter people’s homes without a judge’s warrant, according to an internal Immigration and Customs Enforcement memo obtained by The Associated Press, marking a sharp reversal of longstanding guidance meant to respect constitutional limits on government searches.

The memo authorizes ICE officers to use force to enter a residence based solely on a more narrow administrative warrant to arrest someone with a final order of removal, a move that advocates say collides with Fourth Amendment protections and upends years of advice given to immigrant communities.

I wonder how well this new policy will jibe with the castle doctrine?

[-] Randomgal@lemmy.ca 11 points 3 months ago

Surely it will work, right? All those school shootings and accidental murders, they were for this. To stand up to tyranny. Surely Americans won't just roll over/cheer like they always do. Surely not. Lmao

[-] Catoblepas@piefed.blahaj.zone 7 points 3 months ago

Watching ICE target communities that have intentionally been disarmed as a result of mass shootings: lmao why don’t these dumbasses just shoot someone

[-] finallymadeanaccount@lemmy.world 2 points 3 months ago

I just hope they don't go too hard with the tweets and protests! They're getting results! And democratic senators writing letters! Oof!

/s

(I support the protesters, the ICE victims, and NOT ICE, but day after day it just gets worse, and that's all they're doing - tweeting and marching - as ICE commit atrocity after atrocity).

[-] bdot@lemmy.world 4 points 3 months ago

and what is it that YOU are doing about it?

well - considering the “assassination attempt” on Trump, and how anyone speaking against the regime is a “domestic terrorist,” my money is on the idea that very soon there will be some ICE agents that have an encounter with “ANTIFA thugs,” and this is where martial law will be declared.

Trump is insane right now, and he is big mad that he’s not getting his way in Switzerland; he’s getting bullied right back, and he’s starting to see that people are laughing at him.

[-] SinAdjetivos@lemmy.world 5 points 3 months ago

If that was the goal it would've been false flagged already. The goal really is just a simple as they don't think their actions will have consequences, and so far they've been largely correct.

[-] itistime@infosec.pub 3 points 3 months ago

There already have been false flags. Just ones that sought to incite conflicts between protesters and the boots.

They want blood soaked antifa bodies. It will help to normalize the coming violence to their base. They will frame how it was just. They demonize the slain. It will ratchet it to a new level.

We already know how. It won't.

Conservatism consists of exactly one proposition, to wit: There must be in-groups whom the law protects but does not bind, alongside out-groups whom the law binds but does not protect.

When ingroups do it, its castle doctrine. When outgroups do it its terrorism. There is no law in the US. Just an uncivilized savage land now.

[-] Gerudo@lemmy.zip 2 points 3 months ago

Bet they don't do it in castle doctrine states

[-] peopleproblems@lemmy.world 3 points 3 months ago

Minnesota is a castle doctrine state.

The legal side of it would probably be unfairly weighted in ICE's favor, but I suspect if they tried this in a place like Texas, by the time it got to court, those frozen water nazis would already be shot the hell up.

I expect that within a few months you'll find NICS checks returning "DENY" for anyone who has ties to terrorism. The evidence of terrorism will be membership in things ike the ACLU, being a registered Democrat, having a reading level of 8th-grade or higher, etc.

[-] IchNichtenLichten@lemmy.wtf 23 points 3 months ago

If ICE agents were smart they would refuse to do this. Sooner or later someone is going to defend their home against these goons, using lethal force. The government is deliberately putting these morons in harm's way so they can use the death of an agent as political currency; people like Miller care so little about ICE agents that they wish to see them dead.

[-] itistime@infosec.pub 5 points 3 months ago

MAGAmind have their hands clasped in excitement. They want the violence in the streets. We can’t win direct conflict with their goons. We must not give them what they want. We must circumvent their foot soldiers, and seek direct action against their masters. Make it clear to everyone: go after the money

[-] mystik@lemmy.world 2 points 3 months ago

That's all the excuse they need to ratchet this up another notch.

[-] JusticeForPorygon@lemmy.blahaj.zone 19 points 3 months ago

"advocates say..."

Dude, armed masked individuals are breaking into your house and kidnapping you and your family.

[-] PapaStevesy@lemmy.world 12 points 3 months ago

Well I have a memo deauthorizing it, it's just as legally enforceable as theirs.

[-] Pavidus@lemmy.world 10 points 3 months ago

Castle doctrine says otherwise.

[-] PhatalFlaw@lemmy.world 2 points 3 months ago

Sir, this is ~~a Wendy's~~ Minnesota. There's no castle doctrine, but rather a duty to retreat.

[-] Sprocketfree@sh.itjust.works 10 points 3 months ago

Look, if I'm on that jury I'm not convicting you if nazis break down your door and you start defending yourself

[-] natecox@programming.dev 6 points 3 months ago

I could absolutely be wrong about this because I’ve never really looked it up, but I thought “duty to retreat” still allowed use of lethal force once there is nowhere left to retreat (for example, once in your own home).

Part of those pesky “inalienable rights”.

[-] TranscendentalEmpire@lemmy.today 6 points 3 months ago

Duty to retreat does not apply when you are already in your own home. It's only when you are in public or outside of the protection of your own home.

[-] peopleproblems@lemmy.world 6 points 3 months ago

Incorrect. Minnesota has a castle doctrine for defending your home, a duty to retreat in public.

[-] Pavidus@lemmy.world 3 points 3 months ago

I understand, however in the article it states "The shift comes as the Trump administration dramatically expands immigration arrests nationwide..."

There's a reason this started in areas such as Minnesota. I fully believe this is just trial runs and laying the (il)legal framework to handle more difficult areas.

[-] grue@lemmy.world 4 points 3 months ago

"Nationwide" is sanewashing. It's really expanding specifically to blue states (because its real purpose is punishing the regime's political enemies).

It was only Land of the Free while it was the Home of the Brave, but no one would stand up for their rights so they lost them.

People are already asking how long it will take for an ICE gestapo to get shot

[-] Soulg@ani.social 9 points 3 months ago

I'm shocked everyday that it still isn't happening

[-] frongt@lemmy.zip 6 points 3 months ago

They picked their cities very carefully.

[-] Nollij@sopuli.xyz 6 points 3 months ago

That's part of the goal.

[-] hume_lemmy@lemmy.ca 6 points 3 months ago* (last edited 3 months ago)

Trump previously: "Take the guns first, go through due process second." (actual quote)

Trump today: "Take the homes first, go through due process second."

[-] grue@lemmy.world 5 points 3 months ago

Trump today: "Take the homes first, go through due process second."

There is no evidence for the second half of that.

[-] Atelopus-zeteki@fedia.io 6 points 3 months ago

How long till they break into a home and find themselves in the midst of a boobytrap. Nice bucket of paint over the door, that sort of thing. Nothing harmful, just a bucket of yellow paint to mark the cowards for what they are. This is clearly criminal behavior, and needs to stop.

[-] crank0271@lemmy.world 3 points 3 months ago

I think I've seen this one

Sounds like a fine way to end up eating a buckshot sandwich, but I'm not one to interrupt my enemy while they're making a mistake.

[-] Formfiller@lemmy.world 4 points 3 months ago

I found a memo that says they can’t

[-] bravesilvernest@lemmy.ml 4 points 3 months ago

So they're illegally entering homes? Nice, we should stop them?

crickets

GDI

[-] credo@lemmy.world 2 points 3 months ago

You need to become the criminal to oust the ~~criminal~~ civil offender.

[-] frustrated_phagocytosis@fedia.io 3 points 3 months ago

That explains the lack of willingness to show judicial warrants: there aren't any because fuck you!

[-] Assassassin@lemmy.dbzer0.com 2 points 3 months ago

They can assert it all they want, it won't stop them from being shot.
