Can someone explain how a US state can legally/physically block access to anything from a US federal law enforcement agency?

I genuinely don't understand what's going on here.

[-] walter_wiggles@lemmy.nz 109 points 8 months ago
  1. Start breaking the law
  2. Someone says "that's illegal, you can't do that"
  3. Continue breaking the law
  4. Someone takes you to court
  5. Continue breaking the law
  6. Court decides you're breaking the law, tells you to stop
  7. You say "oh, my bad" and stop
  8. There are no consequences for your transgressions and by the time the courts made a decision you had already achieved your goals.

More like, "I'm sorry you feel that way. This is also not an admission of guilt or fault."

[-] PugJesus@kbin.social 17 points 8 months ago

"And also, we're not actually stopping."

[-] randon31415@lemmy.world 10 points 8 months ago

Step 7 is get some other group (prison riot police, armed volunteers, citizens looking for a bounty payoff) to start doing it, then go back to 1.

[-] PugJesus@kbin.social 50 points 8 months ago

Okay, here is the advanced legal analysis of the situation:

Laws only matter when they're enforced.

That's it. That's what Texas is banking on.

[-] rayyy@lemmy.world 3 points 8 months ago

Laws only matter when they’re enforced.

Applies to the big orange mobster and GOP too.

[-] Dagwood222@lemm.ee 16 points 8 months ago

This is a big Republican tactic. If the Republicans [aka the GOP] have control of a state government, they can pass a law that they know will be struck down in Federal court. Say they mandate that all classrooms have a cross on the wall. The Left has to spend time and money fighting the law. Meanwhile, the GOP can tell their voters that they, the GOP, are protecting the rights of the persecuted Christians. Since the GOP runs the state government, they don't have to pay for the law suits out of their own pockets, the taxpayers foot the bill.

It a political theater that panders to their base, and costs the Left money to fight.

[-] Deceptichum@kbin.social 12 points 8 months ago

Well who’s going to stop them?

That’s how.

[-] CeeBee@lemmy.world 2 points 8 months ago* (last edited 8 months ago)

I would assume the military

Edit: and yes I realize that would be very close to civil war territory, and yes I would assume the Texas State people involved would probably be hanged

[-] BigMacHole@lemm.ee 49 points 8 months ago

Imagine if Lefties decided to block the Government from doing their job! They'd be rounded up and put into unmarked "police cars"!

[-] NotMyOldRedditName@lemmy.world 18 points 8 months ago

You haven't taken skin color into account there

[-] Rapidcreek@lemmy.world 47 points 8 months ago

This state and federal authority confrontation reminds me of Alabama, 1962. Of course, what happened then was the President issued an executive order which federalized the Alabama National Guard, and then commanded they stand down.

[-] FlashMobOfOne@lemmy.world 30 points 8 months ago

I would be really impressed if Biden had the balls to order the National Guard in a'la George Wallace.

But he won't.

[-] Rapidcreek@lemmy.world 24 points 8 months ago* (last edited 8 months ago)

Well, maybe that's what Abbott wants him to do. It's an election year and that could end up being a narrative

[-] FuglyDuck@lemmy.world 10 points 8 months ago

As apposed to the narrative that Biden hasn’t got the balls?

Either way is a narrative. So i side with the rule of law. Im tired of these chucklefucks shitting on everything, ruining people’s lives.

It’s time they see consequences.

Wasn't the Texas governor recently saying how they were stopping just short of murder at the border? This sounds like murder.

[-] NotMyOldRedditName@lemmy.world 17 points 8 months ago* (last edited 8 months ago)

It's probably something more like Gross Negligence Manslaughter

Gross negligence manslaughter is a crime that is committed when someone in an official position commits an unlawful act that they should have been able to see would result in the death of another.

[-] Aylex@lemmy.ml 6 points 8 months ago

No I think he said they would straight up shoot people crossing the border, but unfortunately the Biden administration would charge them with murder ¯\_(ツ)_/¯

[-] NotMyOldRedditName@lemmy.world 9 points 8 months ago

He did, so instead they stop the border patrol and let them drown.

Gross Negligence Manslaughter - illegally prevented the border guard from saving them resulting in their reasonably predicted death.

They didn't physically drown them themselves, so a straight Murder charge wouldn't stick.

If they aren't willing to start making arrests the demand means nothing and when it is ignored Biden will lose face.

[-] mateomaui@reddthat.com 22 points 8 months ago

So how long before we just straight declare war on Texas?

[-] Know_not_Scotty_does@lemmy.world 23 points 8 months ago

I live in Texas, and as an American Citizen, I am asking to be rescued from this hostage situation. Please send help.

[-] bitwolf@lemmy.one 5 points 8 months ago* (last edited 8 months ago)

Same, my dumbass came here for a job. "It's such a great area you'll love it here."

Now I'm depressed, and I get irritated every time I go outside from how terrible the city / road planning is here.

So now I'm just here job hunting, worst case I vote for less shitty politicians while I'm here, but hoping I can GTFO of here soon.

[-] AquaTofana@lemmy.world 3 points 8 months ago

Please! Give us refugee status and then cut this state from the US! And let Texas take Florida with them!

[-] smokin_shinobi@lemmy.world 2 points 8 months ago

What about the people that feel they are being held hostage in Florida?

[-] AquaTofana@lemmy.world 2 points 8 months ago

Oh anyone sane is welcome to seek refugee status in the US. I just feel like the majority of idiots are currently located in these two states, so it'd be easier to save the few with braincells left and then cut the land mass off like a cancerous tumor.

The remaining population will enjoy it, being their own "independent countries" while not having to worry about those inconvenient things like women and LGBTQ+ people accessing Healthcare. Then they can be free to enjoy all the oppression that God intended.

If we win, T*xas is no more.

If they win, T*xas is no longer part of the USA.

I see no downsides.

[-] EdibleFriend@lemmy.world 20 points 8 months ago

I'm sorry man but censoring the name of the state is pure fucking cringe.

[-] PugJesus@kbin.social 7 points 8 months ago

I'm sorry, there are children about, I wouldn't want to warp their sensitive minds with something as vile as the Lone Star State.

[-] ares35@kbin.social 27 points 8 months ago

just start calling it the 1-star ★☆☆☆☆ state.

[-] FuglyDuck@lemmy.world 5 points 8 months ago

Sometimes, I really hate they don’t let you give zero stars.

This is one of those times

[-] Orbituary@lemmy.world 1 points 8 months ago

Tex☆s would have been more clever.

Welcome to the soft coup. All but guaranteed based on how the US dealt with the hard coup attempt. They saw the consequences for actual treason and though to themselves, "I bet I can get away with this." You just know DeSantis is chomping at the bit to ignore the law once his campaign meets it's eventual end.

[-] moistclump@lemmy.world 18 points 8 months ago

For us only invested enough in the story to peruse the comments… why is Texas blocking access to border control?

[-] Seasoned_Greetings@lemm.ee 55 points 8 months ago* (last edited 8 months ago)

Texas politicians use illegal immigration as a wedge issue to fire up voters. Despite the fact that immigration across the Texas/Mexico border goes in both directions and generally hasn't changed in several decades, Texas politicians have increasingly used the fact that illegal immigration exists to distract their racist and xenophobic conservative voters from seeing how shitty their policies actually are.

It's rage bait for conservative voters. Just like how republican politicians have been sending bus loads of immigrants to Northern cities. There's no purpose except to stroke the hate boners of their voters.

Now Texas authorities have illegally issued orders to stop border patrol (a federal agency) from intervening on the increasingly hostile and deadly measures to keep immigrants from crossing the border. Despite the fact that seeking asylum is in fact a legal act. In a recent case, Texas authorities stopped border patrol from rescuing a mother and her drowning children, all of which are now presumed dead.

Gov. Abbot said only a few days ago that he would order Texas authorities to shoot immigrants but he can't because "Biden would charge him with murder"

Republicans expect this issue to be the double whammy of "look see we're doing something about immigrants" and "big bad Biden is trying to stop us!" and look great to their racist, xenophobic base

[-] Tbird83ii@lemmy.dbzer0.com 9 points 8 months ago* (last edited 8 months ago)

My conservative mother in Minnesota keeps talking about "our southern border", and I silently am laughing about how it sounds like she is arguing about Iowans crossing illegally into Minnesota...

Point being, the rage baiting works around the entire country for xenophobic conservatives.

[-] Lath@kbin.social 9 points 8 months ago

Border control takes in fleeing refugees. Texas doesn't want to.

[-] mozz@mbin.grits.dev 7 points 8 months ago

Starting to escalate to "do what I want / let me do what I want, or I'll shoot you" at some point has been in the right-wind playbook for a while now. The Florida State Guard is an experiment with it (within the "establishment", which is much more dangerous than something like the Proud Boys or Patriot Front); this is another. It seems actually pretty important exactly how this plays out and whether it "works" or not.

[-] Bitrot@lemmy.sdf.org 1 points 8 months ago

Florida is just copying Texas which has had a state guard since forever. Florida did too but it had been deactivated.

Sounds to me like they're establishing a new border. Just make it official, re-draw the line and give Mexico a spite exclave.
