Activists don't need the personal information of people they disagree with. Terrorists do, charge them accordingly.

[-] Guy_Fieris_Hair@lemmy.world 59 points 5 months ago

Terrorist-a person who uses unlawful violence and intimidation, especially against civilians, in the pursuit of political aim

Hmmm.... that DOES sound a bit familiar...

10 years seems pretty low for this tbh

[-] FlashMobOfOne@lemmy.world 18 points 5 months ago

Agreed. Handing over personal info is not unlike handing the wrong person a loaded gun.

What a clusterfuck of a HIPAA violation.

[-] barsquid@lemmy.world 57 points 5 months ago

HIPAA seems to be one of the rare laws that actually results in significant damages. Will be interesting to see the size of the fine on this.

Likely the hospital gets hit as well for allowing him access to medical records on patients he had nothing to do with. Shouldn't have been possible in the first place.

This guy's career is over. I'm sure he'll do okay financially by selling ivermectin to bigoted dimwits, but I doubt he will be practicing real medicine ever again.

[-] roguetrick@lemmy.world 36 points 5 months ago* (last edited 5 months ago)

Shouldn’t have been possible in the first place.

I have yet to see a EHR that has access restrictions that would prevent this. Instead it's just logged and if irregular enough you get to have a hostile conversation that could lead to this.

Edit:

Haim, a Dallas surgeon, previously had done some work at Texas Children’s Hospital as part of his residency. The indictment against Haim alleges that in 2023, he asked to reactivate his login there to access information on pediatric patients not under his care, including names, attending physicians and treatment codes, then turned over the information to a media contact.

Okay, that's just dumb. Texas Children's Hospital is going to get fucked over this. Not only did he not have admitting privileges, he didn't even fucking remotely work there. This isn't just a HIPPA violation, it's straight up fraud.

Correction: his career has changed. He will be taken in as a consultant in some right wing think tank and start shaping the direction of the movement, because he “took action”

[-] ours@lemmy.world 7 points 5 months ago

Or at the very least, get this own alt-right podcast.

Nono, his new career as a right wing mouthpiece is just beginning. He'll be up on stage with MTG and Rittenhouse complaining about cancel culture and how woke has invaded hospitals and how you shouldn't listen to doctors.

Until it's appealed to the Supreme Court 🙃

[-] HonkTonkWoman@lemm.ee 10 points 5 months ago

Don’t jinx us now… there are plenty of idiots in Washington willing to pay idiots to say the things they want said.

I’d wager this asshole would be willing to say a lot.

[-] PM_Your_Nudes_Please@lemmy.world 9 points 5 months ago

Multiple violations, because he released multiple patients’ info. Off the top of my head, I believe it’s up to $250k and 10 years per violation, but the jail time could be served concurrently instead of consecutively.

The irony of the doctor's name not being in the headline....

His name is Dr. Eithan Haim

[-] norimee@lemmy.world 27 points 5 months ago

Yes! SAY HIS NAME!

We need to name and shame these people all the time.

And we are revoking his license, right?

[-] meep_launcher@lemm.ee 14 points 5 months ago

At least in this administration.

Don't forget to vote in November. I know we all said we aren't voting for Biden but the realities for project 2025 are beginning to set in.

Facing possible jail in Texas isn't exactly a price being paid, is it?

[-] JJROKCZ@lemmy.world 25 points 5 months ago

Compromising PII is a hipaa violation, that isn’t taken lightly anywhere. He may not get the full 10 years but he will be slapped for this.

[-] norimee@lemmy.world 50 points 5 months ago

Will he loose his licence for this? Because he should. Anyone leaking patient data on purpose should never have access again.

What I mean is even if he was facing the death penalty or 1 billion years in prison, he hasn't paid, has he. The penalty has been added to cart.

Tangent: I have no faith in the American justice system, much less in any red state's "justice" system. He'll get slapped...on the wrist...using some mental gymnastics about whistleblowers or something like that.

[-] cultsuperstar@lemmy.world 23 points 5 months ago

Just 10 years for violating HIPAA? I would thing it would be longer

[-] Daxtron2@startrek.website 14 points 5 months ago

He probably won't get anywhere close to 10 years, if he even gets prison time.

The people that are desperately clinging onto the hope that this is any kind of victory needs a reality check.

In the extremely unlikely scenario that he actually gets jail time they'll be high-fiving him all the way in - and you better know that any parole hearing he's going to get (which will probably be sooner rather than later) will be staffed by people who think exactly the same way he does.

Hierarchy is the bedrock of reactionary politics - and it doesn't get any more hierarchical than the (so-called) "justice system."

Anti-trans doctor

First guess was Florida, second was Texas.

[-] Streetlights@lemmy.world 15 points 5 months ago

For what possible purpose would he need medical records? It can't be money surely.

[-] snekerpimp@lemmy.world 35 points 5 months ago

For finding and eliminating the “vermin” the orange shit stain keeps screaming about.

So, are all conservatives blood lusting, self centered, self absorbed ass holes?

[-] ZeroCool@vger.social 12 points 5 months ago* (last edited 5 months ago)

Yes, and the ones that claim not to be are still voting for those who are. At that point it's a distinction without a difference.

[-] Streetlights@lemmy.world 7 points 5 months ago

Elimination? He should be up on terrorism charges. Was he passing the info onto some sort of right-wong militia group?

[-] snekerpimp@lemmy.world 9 points 5 months ago

You’re right, he should be.

[-] norimee@lemmy.world 23 points 5 months ago

It's not about the details of care, but the general information on who is transgender and who was providing or was involved in the care.

With the purpose to "cause malicious harm" as the article says. Which means, they will harass and try to scare involved parties into hiding, leaving or stopping to provide care.

This Conservative activist already published the information to discredit the children's hospital, create a scandal on how they are harming children with the goal that the hospital will stop providing care in fear of bad press.

Their goal is to scare every trans person back deep into the closet (or to leave) and to scare all possible care out of existence, even when legal.

The basic motive is HATE. Plain and simple. Hate of that what is different and the need to control the people around them to live by their beliefs and moral standards.

[-] Streetlights@lemmy.world 11 points 5 months ago

Thank for taking the time to lay that out for me. I am unable to comprehend the motives, but that at least starts to explain it. Unthinkable.

Dude forgot his hippocratic oath.

It was purely ideological. He claims to be a whistleblower, but he's just a bigoted asshole that has no business working in medicine.
